Overview

The Marlborough District Council (Council) is proposing amendments to the Navigation Safety Bylaw 2023, following its review.

Under the Maritime Transport Act 1994 (MTA), the Council has the authority to regulate harbours, waters, and maritime-related activities in the Marlborough region.

Under section 33M of the MTA, the Council has the power to make bylaws for the purpose of ensuring maritime safety in the region. Section 158 of the Local Government Act 2002 requires local authorities to review a bylaw made by it under the Maritime Transport Act 1994 no later than 5 years after the date on which the bylaw was made.

The Bylaw has been reviewed to address the matters the Council signaled it would consider in a review later rather than at the time the Bylaw was initially made. Other amendments are also proposed to the Bylaw to improve workability and clarity and address other issues that have arisen since the Bylaw came into force in 2023.
