Proposed Draft Trade Waste Bylaw 2025
Overview
We are proposing to replace the Trade Waste Bylaw 2011 with the proposed Draft Trade Waste Bylaw 2025 (Draft Bylaw).
Trade waste discharged into the public wastewater system can negatively impact the environment, public health, and Council infrastructure.
It is produced by various businesses, including wine producers, manufacturers, food outlets, service stations, hairdressers, abattoirs, fish/mussel processing, dentists and medical centres.
The proposed Draft Bylaw provides Council with an opportunity to improve how trade waste discharges are regulated. By replacing the 2011 Bylaw with an updated replacement bylaw Council can maintain regulating trade waste and tanker discharges into the public wastewater system, and:

- Ensure they are fit for purpose with the changes in the district since 2011;
- Address bylaw implementation issues to enable effective enforcement; and
- Update legislation and bylaw references (editorial changes).
There are limited changes in the proposed Draft Bylaw, as the Council considers the 2011 Bylaw to be generally fit for purpose and this replacement is largely procedural.
The main areas of change in the Bylaw are:

- Key Change: New Conditional Consent required for Tanker operators.

- Minor changes: several changes have been made to aid in clarity, remove unnecessary elements and align with aspects of the New Zealand Standards model bylaw.
